TERMS AND AGREEMENT ES Producation Services Sdn Bhd ("ESPS", "we", "us", or "our") operates the Educator Purchase Programme ("EPP"), a platform that enables eligible Malaysian government school teachers to purchase educational equipment through an easy payment plan. By registering for or using the ESPS application and services, you agree to be bound by the following terms and conditions. 1. ELIGIBILITY You must be a confirmed Malaysian government school teacher, at least 18 years of age, holding a valid MyKad (Malaysian national identity card), and in a permanent or contract teaching position to use our services. We reserve the right to verify your eligibility at any time and to suspend or terminate access if eligibility requirements are no longer met. 2. ACCOUNT REGISTRATION You agree to provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at esp.credit.my@gmail.com of any unauthorised use of your account. One account per individual is permitted; sharing accounts is strictly prohibited. 3. EASY PAYMENT PLAN The Easy Payment Plan allows eligible teachers to purchase approved equipment and repay the product price in fixed, equal monthly instalments over an agreed tenure (e.g. 6, 12, or 24 months). There are no interest charges, hidden fees, or processing fees applied during your instalment tenure — you pay only the product price divided equally across your chosen number of months. Your instalment amount, tenure, and total payable amount will be clearly displayed before you confirm any purchase. Purchase limits are determined at our discretion based on your eligibility profile and may be revised at any time. 4. PAYMENT OBLIGATIONS & LATE CHARGES You agree to make timely monthly payments as scheduled. Your monthly instalment amount and due date are fixed and stated in your purchase agreement. You may make early or additional payments at any time without penalty. A late charge of 1.5% per month will apply on any outstanding balance remaining after your agreed instalment tenure has ended. This late charge is calculated on the remaining unpaid balance after the contract end date, not on individual monthly payments during the tenure. We reserve the right to suspend your purchasing privileges if payments remain outstanding after the contract period. 5. PRODUCTS AND DELIVERY All products offered on the platform are subject to availability. Product specifications and pricing may change without prior notice. Products will be delivered to the address you provide at the time of purchase. Ownership of the product transfers to you only upon full settlement of all instalments. 6. WARRANTIES AND RETURNS Products carry manufacturer warranties as stated at the time of purchase. Warranty claims must be submitted through the ESPS application. Warranties do not cover damage resulting from misuse, negligence, or unauthorised modifications. Return and exchange eligibility is subject to individual product policies communicated at the point of sale. 7. INTELLECTUAL PROPERTY All content, trademarks, logos, and materials on the ESPS platform are owned by or licensed to ES Producation Services Sdn Bhd. You may not reproduce, distribute, or create derivative works from any platform content without our prior written consent. 8. LIMITATION OF LIABILITY ESPS shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, our services. Our total liability to you shall not exceed the amounts you have paid under your active agreement. We do not guarantee uninterrupted, error-free access to the platform. Force majeure events, including but not limited to natural disasters, government orders, or network disruptions, may affect service availability. 9. TERMINATION You may request account closure by contacting our support team. Any outstanding balances remain payable upon account closure. We reserve the right to suspend or permanently terminate accounts that violate these terms, engage in fraudulent activity, or pose a risk to other users or the platform. Upon termination, your personal data will be handled in accordance with our Privacy Notice and applicable law. 10. AMENDMENTS We reserve the right to amend these Terms and Agreement at any time. Changes will be communicated to you via email and in-app notifications. Your continued use of the platform after any such changes constitutes your acceptance of the revised terms. 11. GOVERNING LAW These Terms and Agreement are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from or in connection with these terms shall be submitted to the exclusive jurisdiction of the courts of Malaysia. 12.
