Agreement Overview
These Terms of Service govern your use of the ESPS mobile application and related services provided by ES Producation Services Sdn Bhd. By registering for or using our services, you agree to be bound by these terms. Please read them carefully before proceeding.
Eligibility and Registration
Who Can Use Our Services
- You must be a confirmed Malaysian government school teacher
- You must be at least 18 years of age
- You must hold a valid MyKad (Malaysian identity card)
- You must have a confirmed permanent or contract teaching position
Account Responsibilities
- You are responsible for maintaining the security of your account credentials
- All information provided during registration must be accurate and up to date
- You must notify us immediately of any unauthorized use of your account
- One account per individual; sharing accounts is not permitted
Credit and Payments
Credit Facility
- Credit limits are determined based on your eligibility assessment
- Credit may be used to purchase approved products through the ESPS platform
- All credit facilities are subject to approval and may be adjusted at our discretion
- A profit rate may apply to purchases as disclosed at the time of transaction
Payment Terms
- Payments are made monthly through the ESPS mobile application
- Payment reminders will be sent before each due date
- Late payments may incur additional charges as specified in your agreement
- You may make early or additional payments at any time without penalty
Products and Warranties
Product Terms
- All products are subject to availability
- Product specifications and pricing may change without notice
- Products are delivered to the address specified during purchase
- Ownership transfers upon full payment of all instalments
Warranty Coverage
- Products carry manufacturer warranties as stated at purchase
- Warranty claims must be submitted through the ESPS application
- Warranty does not cover damage from misuse or unauthorized modifications
- Replacement or repair timelines depend on manufacturer availability
Limitation of Liability and Termination
Limitation of Liability
- ESPS shall not be liable for indirect, incidental, or consequential damages
- Our total liability is limited to the amounts paid by you under your agreement
- We do not guarantee uninterrupted or error-free access to our services
- Force majeure events may affect service delivery timelines
Account Termination
- You may request account closure by contacting our support team
- Outstanding balances remain payable upon account termination
- We reserve the right to suspend or terminate accounts that breach these terms
- Upon termination, your data will be handled per our Privacy Policy
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
